716.5 Rehabilitation facility construction projects completed or approved between October 14, 1998 and December 31, 2010.

(a) This section applies to rehabilitation facility construction projects approved by the department or commissioner between October 14, 1998 and December 31, 2010 and to rehabilitation facility construction projects not requiring such approval that are completed between October 14, 1998 and December 31, 2010. Rehabilitation facilities shall comply with the requirements of Chapter 10, "Rehabilitation Facilities", of 1996-97 Guidelines for Design and Construction of Hospital and Health Care Facilities, 1996 edition. Further details concerning the referenced material are contained in section 711.2(b)(6) of this Title.

(b) Notwithstanding any provision herein to the contrary, a licensed operator or applicant, when submitting a construction application for approval, may elect to comply with all applicable requirements of section 716.6 of this Part in lieu of complying with this section.
