Section 98-1.1 Applicability.

This Part shall be applicable to all persons who propose to establish and/or operate a health maintenance organization (HMO), special purpose health maintenance organization, also known as a prepaid health services plan (PHSP), comprehensive HIV special needs plan (HIV SNP) or, as specified, a primary care partial capitation provider (PCPCP) or managed long term care plan (MLTCP) or who currently operate an HMO, PHSP, HIV SNP or, as specified, a PCPCP or MLTCP certified under article 44 of the Public Health Law within the State of New York, which may hereinafter be referred to individually or collectively as managed care organizations (MCOs).
